The Whole house is yours for the stay.
Please confirm the number of people in the booking; adults and children. If you are booking for another person then we would need their Name and Telephone number.
Working crews will have to let us know in advance the number of people coming as well as their Company name. We do not allow heavy equipment or heavy trucks on the property. !!

Via the channel

Englewood is so lovely that two counties – Charlotte and Sarasota along Florida’s Gulf Coast – insist on sharing in its beauty.

Englewood's uncrowded beach is pure and wide and has excellent facilities. Just south, you'll find Blind Pass Park, a fantastic place for shelling and finding sharks' teeth.

Plenty of golf is available in and around Englewood, and the birding is great.

You can also try parasailing or rent a jetski. Fishing in Englewood is also outstanding and several companies will take you out on their boats.

Absolutely embark on an eco-tour of Lemon Bay. You’ll almost certainly see dolphins, manatees, and all kinds of shorebirds and wildlife.

Famous town of Venice is only 30 mins from here.

**Check In**
 Touch the lock and numbers appear – Enter passkey and it will unlock
 The front door has a Ring camera doorbell system that provides video of who enters the house. This has been installed for the safety & security of the house during unoccupied times and as a necessary precaution.
 Wifi is AvatartreeVacationsGuest, Wifi password is Dragonfly7000*
 TV's are Internet based and connected to Wifi. There are no channels. Please use your streaming services like Netflix, Disney + and Prime or LG TV's channels for sports and news
 You can Park on the driveway. Please don’t use the garage if you don’t have to. There are boxes, storage inside and the space is tight
 Please be nice and respectful in the neighborhood. Drive slowly and obey traffic signs. They live long term there and we would like to keep good relations with all of them
 Please dont bring sand into the house, leave sandy footwear outside and hose them off if needed
 There are a lot of fine decorative art pieces in the house. Please do not allow children to touch them or move them – they are delicate and can break. These pieces were selected with great care to provide the ambience and serenity for the house. Much appreciated !!
 Absolutely NO SMOKING OR VAPING in the house or outside, including the Pool area - on the premises. Evidence of smoking will result in additional fees and costs to remove the damage

 No LOUD Partying or music - lets be reasonable and respect our neighbors. Quiet times are from 10:00 pm to 8:00 am
 No pet policy and followed very strictly
 No illegal activity or illicit drugs will be tolerated
 Check in and Check out times are strictly to be followed in order for us to prepare the house for our next Guest. Check in after 4:00 pm and check out by 11:00 am.
 # of Guests - please restrict occupancy to number of Guests that are reflected in the booking. At any time we are unable to allow more than the Occupancy of the house as allowed by the State. We reserve the right to inquire the names and ages of guests as needed. This is for our own safety.
If you are booking on behalf of someone else please state that upfront as we expect only that person who booked to occupy the house. we would need the persons name, Drivers license for the booking.

**WATER**
 PLEASE NOTE: The water is from the city and seems good for bathing, washing etc ; BUT IT IS NOT MEANT FOR COOKING OR DRINKING. We do not have a reverse Osmosis system in place. We plan to upgrade shortly. Please use bottled water for drinking and cooking during your stay.

**PESTS:**
• Florida is a tropical place. There are plenty of bugs that are in and out if we don’t keep our doors closed. We use a professional pest control company to treat this house as a precaution.
• If you notice any bugs please let us know

Pool:
 This house comes with a beautiful well maintained pool. The pool is serviced every week and the water is checked for cleanliness.
 Please observe the following rules for the Pool:
a. Please observe ALL necessary safety precautions for using the pool.
b. You can use the pool at your own risk. The Primary guest is responsible to ensure that ALL Safety precautions are taken while using the pool
c. By reading these house rules and by virtue of accepting a booking at this house you will follow the Pool rules and will not hold the Host and associates responsible for any liability due to mishaps or injuries on this property.
d. Remember that it is wet on the sides of the pool. Please be careful walking around the pool. We are not liable for any falls or injuries caused.
e. No jumping or diving into the pool.
f. All children will be supervised by adults at ALL times – no exceptions. They should NOT be in the water by themselves whether they have floaters or not
g. The sliding doors from the house and the connecting door have alarms to indicate that someone has entered the Lanai. Please supervise at all times. Please do not turn off these alarms or leave these doors open at all times. They are for your own safety and security.
h. At night the pool area is well lit. Do not use the pool in the dark
i. It is the responsibility of the Primary booking Guest to ensure that everyone is safe, the pool is secure at night and that the Lanai doors are locked and alarms are on.


**Outside Grill**
 Outside Grill operates on Gas. Please follow all Safety drills to be safe. Once finished turn off the Gas regulator and ensure that the fire is off
 We also have a nice gas operated fireplace on the patio. After use please switch of the gas regulator and ensure the fire is off
 There is an Electric Fireplace in the Lanai/family room. It should be switched off when leaving the house even for a short period of time
 NOTE: It is the responsibility of the Guest to operate these conveniences safely. The host does not bear any liability for use/misuse of these items.

**Check out:**
 Check out should be by 11.00 am as we have to prepare for the next Guest.
 Before leaving put all dishes in the dishwasher, used towels and sheets on the floor
 DO NOT throw food into the sink - there is a garbage disposal
 Please turn Thermostat back to 75 Cooling when you leave

**Childproofing:**
 This house is not fully childproofed. We have been careful in securing most items, but we cannot say that it is completely childproof.
 Children are welcome to stay in the house and it is necessary for parents and guardians to supervise young ones at all times

**Rules regarding Service animals:**
Service Animals are allowed and must be declared at the time of Booking with proof of certificate for the animal.
A guest’s service animal must NOT be:
 Out of control
 Unhousebroken
 Left alone at the listing
 Allowed into areas that are considered unauthorized to the guest (not on the sofas and beds)
 Allowed in a public space without being harnessed, leashed, or tethered and not under the guest’s control
 You will still be liable for any damages in the property caused by the support animal

**Rules regarding Emotional Support Animal (ESA):**
 In order for an emotional support animal letter to be valid in Florida, it must be signed and dated on the licensed healthcare professional’s official letterhead and provided as proof before the booking is confirmed
 Florida laws have changed and now make it a crime to misrepresent an animal as an ESA. It can also be considered a crime under Florida law for a healthcare provider to issue a letter in support of an accommodation if they do not have personal knowledge of the individual’s disability.
 ESA should be house trained
 Not be Out of control
 Should be housebroken
 Should not be Left alone at the listing
 Not Allowed into areas that are considered unauthorized to the guest (not on the sofas and beds)
 Not Allowed in a public space without being harnessed, leashed, or tethered and not under the guest’s control
 You will still be liable for any damages in the property caused by the animal
 We will collect a Pet deposit fee for ESA’s. Please contact for more details

We have a strict NO pet policy and any extensive cleaning that we have to do because of bringing in an ESA or a Service animal, the guest will be charged extra cleaning fees.

These House rules are meant to protect the Guest as well as the Host. By booking the stay here and reading these House Rules you acknowledge compliance and free the owner of any liabilities

**Pool Addendum and Waiver:**
THIS POOL LIABILITY WAIVER (the “Waiver”) is entered into the day of occupancy of the GUEST from their portal of booking between Avatar Tree Manor Rd Englewood, LLC the “HOST” with an address at 1677 Manor Rd, Englewood, FL 34223 (the Premises) and the “GUEST” – the person who booked and the person(s) who occupies this house via the short term rental portals known as the “Short Term Tenant” whose name and ID are available as needed from any channel/portal.

Hereinafter, these individuals are known collectively as the “Parties.”
The Parties hereby acknowledge that this Waiver is incorporated as part of their agreement to stay at the property referenced therein as the “Premises” and serves to affirm the following:

**USE**. The HOST agrees to allow the GUEST to use the Pool at the Premises for recreational purposes, subject to all terms and conditions of this Waiver. The HOST is not responsible for any loss of use due to weather, maintenance, or any other circumstances that may cause the pool to become unavailable. The use of the pool is an amenity, the unavailability of which is not a violation of any terms of this Waiver or the Short Term Rental stay agreement from any channel.

**SEASONALITY** The Pool is not heated and hence NOT guaranteed to maintain a certain temperature due to weather or any other natural causes.
INHERENT RISK. The GUEST acknowledges that the use of a pool and activities around the pool involves the potential risk of serious danger and bodily injury if not following basic Safety procedures. The GUEST further acknowledges that these risks may be the result of the actions or inactions of the GUEST, their minor children, guests, or anyone else using or around the pool.

**ASSUMPTION OF RISK** The GUEST will use the pool at their own risk and assumes all risks of bodily injury resulting from or around the Pool located on the Premises. This assumption of risk extends to all tenants, their minor children, guests, or anyone else on the property.

**RELEASE** The GUEST releases the following parties from any loss or damage to property, physical injury, or death as a result of the pool and its use: the HOST, their employees, heirs, and successors. This release extends to the injuries of any party, both directly and indirectly related to the use of and around said pool.

**PRECAUTIONS** The GUEST agrees to take reasonable precautions to ensure the safety of the pool. These precautions include, but are not limited to, locking any entrances to the pool when unsupervised by an adult. Any individual that is unable to swim independently is required to wear an appropriate life vest. These life vests are NOT provided by the HOST. Also to keep the sliding doors locked and keep everyone supervised. Under no circumstances will any ADULT or CHILD be alone in the Pool or the area surrounding the Pool.

**POOL CONDITION** The GUEST agrees to keep the pool clean and not drop food, glasses or other contaminants in the pool that can be potential danger to others. Put away pool toys after use.
REPAIRS. The GUEST is required to notify the HOST immediately if there is any defect or issue that requires repair. If there is damage done to the Pool by the GUEST, the HOST will make assessments and will charge it back to the GUEST

**INDEMNIFICATION** The GUEST agrees to indemnify and hold harmless the HOST from any loss, damage, liability, attorneys’ fees, and costs that are the direct or indirect result of using said pool on the Premises.

**UNSUPERVISED USE** The GUEST acknowledges that the HOST has no responsibility to supervise the use of the pool. It is solely the GUEST’s responsibility to supervise any individuals using the pool. Individuals unable to swim or children who are not allowed to use the pool unsupervised. An adult GUEST must be present at all times while the pool is in use.
PETS. Pets of any kind are not allowed in the swimming pool at any time.

**VIOLATIONS** The GUEST is in default of Short term stay and house Rules for any violation of this Waiver. Said violation may result in the suspension of pool use and/or eviction and termination of stay at the property.

**ACKNOWLEDGEMENT/AGREEMENT**
Electronically reading/scanning and /or accepting to stay at this property; this is part of the House Rules is acknowledgement that the GUEST abides by this Waiver.
